Terms of Service

Welcome to Arise. By downloading, installing, or using the Arise mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

Arise is a fitness gamification application that transforms daily workouts into quests. Users can complete exercises, earn experience points, level up, join guilds, collect items, and compete on leaderboards. The App is free to download with optional in-app purchases.

2. Account Registration

  • You must authenticate via Google Sign-In or Apple Sign-In to use the App.
  • You must be at least 13 years old to create an account.
  • You are responsible for maintaining the security of your account.
  • You may only have one active account at a time.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

3. User Conduct

When using the App, you agree not to:

  • Use offensive, hateful, or inappropriate names for guilds, tags, or descriptions.
  • Harass, bully, or threaten other users through social features.
  • Exploit bugs, use automation tools, or cheat to gain unfair advantages.
  • Manipulate exercise data or submit false workout completions.
  • Attempt to access other users' accounts or data.
  • Use the App for any illegal purpose.
  • Reverse-engineer, decompile, or disassemble the App.

4. Virtual Items & Currency

  • Mana Crystals are an in-app virtual currency with no real-world monetary value.
  • Virtual items, equipment, and currency exist only within the App and cannot be exchanged for real money.
  • We reserve the right to modify, adjust, or remove virtual items and currencies at any time for game balance.
  • In-app purchases are processed by Apple through the App Store and are subject to Apple's terms.
  • Refunds for in-app purchases are handled by Apple according to their refund policy.

5. Premium Subscription (Auto-Renewable)

Arise offers an optional premium subscription ("Arise Premium") available as a monthly or yearly auto-renewable subscription:

  • Arise Premium Monthly: $5.99 USD per month.
  • Arise Premium Yearly: $39.99 USD per year.

By subscribing, you acknowledge and agree that:

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price.
  • You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase.
  • Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
  • Prices are in USD and may vary in other storefronts. Prices are subject to change, but any change will not affect active subscriptions until renewal.

Premium benefits include: premium Battle Pass access, +10% XP and BPP bonus, quest replay, exclusive cosmetic items, and access to personalized training programs. Premium access is tied to your account and is non-transferable.

6. Battle Pass

  • The Battle Pass is a seasonal feature with free and premium tiers.
  • Battle Pass progress (BPP) is earned through gameplay activities.
  • Purchased premium Battle Pass access is valid for the current season only.
  • Unclaimed rewards may expire at the end of a season.

7. Guilds & Social Features

  • Guild names and tags must not contain offensive, hateful, or inappropriate content.
  • Guild leaders are responsible for the conduct of their guild.
  • We reserve the right to rename or dissolve guilds that violate these Terms.
  • Trading between users is a voluntary feature; we are not responsible for trades you choose to make.

8. Discipline Mode (Screen Time)

Arise offers an optional Discipline Mode that restricts access to apps you select until your daily training is completed. By enabling this feature:

  • You grant Arise permission to use Apple's Screen Time API (Family Controls & Managed Settings) to apply app restrictions on your device.
  • You acknowledge that restricted apps will be blocked by a shield screen until you complete your daily quest.
  • You are solely responsible for choosing which apps to restrict and for managing this feature.
  • Arise is not responsible for any inconvenience, missed notifications, or inability to access apps caused by Discipline Mode being active.
  • You can disable Discipline Mode or modify your app selection at any time in Settings.
  • Screen Time authorization can be revoked at any time through iOS Settings > Screen Time.

Discipline Mode is designed as a self-motivation tool. It is not a parental control feature and should not be used as a substitute for parental controls.

9. Health Disclaimer

Arise is not a medical application. The exercises and fitness challenges provided are for general fitness purposes only. You should:

  • Consult a physician before beginning any exercise program.
  • Stop exercising immediately if you feel pain, dizziness, or discomfort.
  • Adapt exercises to your own fitness level and physical capabilities.

We are not responsible for any injuries resulting from exercises performed while using the App.

10. Intellectual Property

All content in the App, including but not limited to 3D models, graphics, text, icons, sounds, and code, is owned by Arise or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our content without prior written consent.

11. Service Availability

  • We strive to maintain the App's availability but do not guarantee uninterrupted service.
  • We may perform maintenance, updates, or modifications that temporarily affect availability.
  • We reserve the right to discontinue the App or any feature at any time with reasonable notice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Arise and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of virtual items, or physical injury resulting from exercises.

13. Account Termination

  • You may delete your account at any time through Settings > Delete Account in the App, or via our account deletion page.
  • We may suspend or terminate your account for violation of these Terms.
  • Upon account deletion, all personal data and game progress will be permanently removed.

14. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes via in-app notification. Continued use of the App after modifications constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of France.
